New panhandling ordinance suggests a variation on playing tag downtown. Those green parking meters are the safe zones.

Members of the city council have decided that current city law restricting panhandling and sitting on sidewalks is not enough. At the city council meeting on April 12, members voted 6 to 1 in favor of passing a new ordinance that prohibits people from panhandling within 25 feet of parking pay stations or ATMs.

According to Olympia’s municipal code, aggressive panhandling is already illegal. It’s also illegal to sit or lie down in the way of pedestrians.

The new ordinance will amend existing law about pedestrian interference. Mechanical parking meters are not included, only ATMs and the new electronic parking pay stations purchased last year. Some cities in Washington, including Lacey, already have similar ordinances. The council will have a second reading of and will likely approve the ordinance at their April 19, 2011 meeting.

During the public comment section, Rosalinda Noriega gave a compelling comment on how the new panhandling ordinance could harm marginalized communities in Olympia:
“I’m concerned that an ordinance such as this would be a tool for further dividing the classes.”

“I have a young friend who suggested that this ordinance is a form of tag, that if you’re standing close enough to the parking meter, that you’re safe. You don’t have to get approached.”

“I’m concerned that criminalizing this behavior, it’s really not a solution.”

“The impact that it ends up having is that it makes some of us feel more comfortable and it criminalizes the behavior of others.”

“I would really encourage the city to not only get the input of social service providers that work with the most marginalized communities in Olympia and in Thurston county, but I would also strongly, strongly suggest that you also communicate with the populations themselves. To not rely on social service providers to be the voice for the community, but to let the community be their own voice.”

“I would really encourage you to find ways to not only invite people to come into your space to speak, but also to come out of your space to ask respectful questions and to listen with all your hearts and minds.”

Council member Jeannine Roe responded to public comment about the panhandling ordinance with photos of two examples of parking pay stations being blocked, and conveyed the need to keep parking pay stations open for people to use them.

“I just think out of respect to our citizens in the community who want to shop downtown and feel comfortable going to the pay stations,” said Roe, “we actually are having a heck of a time with the pay stations as is, much less having them available for people to step up and pay.”

“We want them to come downtown, we want them to use these pay stations,” said Roe.

Steve Langer stressed the safety and comfort of those using parking pay stations or ATMs. “We actually decided to do a 25-foot area just so that people who are taking money out of their pockets, or credit cards and so on, can do that without feeling hassled.”

Langer also explained that only 25 feet of the roughly 270 feet in each city block that has a parking pay station will be off-limits for panhandlers. That’s not quite true. According to the ordinance, the 25 feet is a radius, so it would be more true to say that roughly 50 feet along the length of the sidewalk will be off-limits. So, the length of sidewalk that restricts panhandling is still less than roughly a fifth of the length of an average Olympia city block. That doesn't include instances where there's a parking meter and an ATM on the same length of sidewalk, but Langer's sentiment stands: this ordinance restricts panhandling in specific portions of downtown, not entire city blocks.

Rhenda Strub stated that she shared the concerns raised by Rosalinda Noriega and another commenter. “I had debated all day about whether I was going to pull this item from consent for further discussion or whether I would just vote no.”

Strub met with an unstated number of social service providers, and following their advice, said Strub, she only voted no on the ordinance instead of holding it back for further discussion.

“They didn’t want to take up this fight,” said Strub.

The new panhandling ordinance seems like an insult to poor people, said Strub, “but there are greater fights to be fought.”

Perhaps there should be more discussion of those “greater fights to be fought.”
